Referral Program Terms

The following Referral Program Terms (“Terms”) apply to your participation in the Referral Program (the “Program”) offered by SG Hosting Inc., a Delaware company with its principal place of business at 700 N. Fairfax St, Suite 614, Alexandria 22314 VA, USA (“SiteGround”, “we”, “us”, “our”). The terms “you” and “your” refer to any individual or entity who is a SiteGround customer and participates in our Referral Program.

  1. Participation in Our Referral Program

SiteGround customers with an active shared and/or cloud hosting plan can participate in our Referral Program. By using the unique referral link available in your SiteGround Client Area to refer new customers to us, you declare that you have read, understood and agreed to be bound by these Terms.

  1. Conditions for a New Valid Referral

We will award you with a certain period of free hosting as an extension to one of your active hosting accounts for each New Valid Referral. A New Valid Referral means that all conditions below are met:

  • You refer our hosting and/or email marketing services to a new customer who priorly did not purchase a service from any of the companies part of SiteGround Group of companies (“Valid New Customer”);

  • The Valid New Customer orders at least one hosting or email marketing service from a company part of SiteGround Group of companies (each hereinafter referred to as “SiteGround entity”);

  • At the time of the initial order posted by the Valid New Customer, our tracking system identifies that such customer has your referral cookie as a last referrer and you have an active SiteGround hosting account;

  • The Valid New Customer keeps the hosting or email marketing service with the SiteGround entity active for a period of at least 30 days after the First Service Payment. The First Service Payment means the payment of the fees made by the Valid New Customer for the entire term of а hosting or email marketing service order. Payments of upgrade fees are not covered under the definition. 

  1. Free Hosting Referral Awards

Your free hosting referral award depends on the hosting plan with SiteGround you select to add it to. If you have more than one hosting plan, you will need to specify which should be the one associated with the referral awards.

Each referral award can only be applied to one of your active hosting plans. Each New Valid Referral is awarded as follows, depending on the hosting plan you select to add your award to:

  • When added to а StartUp plan - the award will be 3 months free StartUp hosting;

  • When added to a GrowBig plan - the award will be 2 months free GrowBig hosting;

  • When added to a GoGeek plan - the award will be 1 month free GoGeek hosting;

  • When added to a Cloud plan - the award will be 1 day free Cloud hosting.

You can have up to 12 free months from referral awards added to each of your shared hosting plans and up to 150 free days added to each of your Cloud hosting plans during the calendar year.

Free hosting referral award has no cash equivalent. Upon a New Valid Referral, the award is automatically added to your active hosting account. If you have more than one active hosting account, the free hosting referral award will be added to the active hosting account you manually select from your SiteGround Client Area.

  1. Your Responsibilities

4.1. You agree that:

  • You should act in good faith to refer our hosting and email marketing services to third parties, which will be customers in good standing. Customers in good standing are persons or entities which meet the requirements of the SiteGround Terms of Service (and Email Marketing Service Terms, if such customers purchase SiteGround email marketing service), have provided valid contact information, are not flagged for high fraud risk, and have active customer accounts.

  • You should not engage in incentivized programs and business-opportunity sites, using marketing practices that might be unethical or likely to attract potential SiteGround customers not in good standing. You shall not use any illegal or inappropriate ways of advertising such as:

  • Mass texting, blackhat seo/spam link building techniques, mass emailing, unsolicited emailing, unauthorized placing of the link in forums, newsgroups, message boards, copyright or trademark infringing content, etc.;

  • Bidding on keywords and phrases containing the "SiteGround" trademark, or variations or misspellings of the trademarked term on Pay per Click or Pay per Impression campaigns on the search engines (Google, Bing, Yahoo!, Yandex, MSN, Ask.com, or others) without our prior written approval. You are not allowed to use the website of a SiteGround entity (“SiteGround Website”) as display URL in PPC ads and to direct-link or redirect to the SiteGround Website;

  • Using traffic generated by pay to read, pay to click, banner exchanges, click exchanges, PPV advertising, pop-up/under, or similar methods;

  • Using iframes or any other techniques or technology that places your referral tracking cookie by any means other than an actual click-through.

  • You should not take actions or make recommendations to your referrals that result in a potential revenue loss for SiteGround.

  • You should promote SiteGround in an ethical way, should not misuse its confidence and shall not damage its reputation. This provision shall survive termination of these Terms.

  • You shall not disclose to third parties any Confidential Information provided under these Terms, unless otherwise permitted under these Terms. For the purposes of this clause, “Confidential Information” shall mean any and all communication between you and SiteGround related to your participation in this Referral Program.The confidentiality obligations described herein shall survive termination of these Terms.

4.2. We reserve the right to request additional data regarding the referral practices you use. Failure to provide accurate information may result in exclusion from the Program and forfeiture of any awards.

4.3. If we detect any action or pattern in your referral practices that in our opinion violates any aspect of these Terms, we reserve the right to exclude you from the Program and cancel all pending awards due. 

5. Referral Tracking Cookies

The unique referral link from your SiteGround Client Area shall be used and shared as it is. We track referral sales automatically by the use of a referral tracking cookie. The referral tracking cookie is placed in the browser of the user that clicks on the referral link to reach the SiteGround Website. Each cookie is stored for 60 days. If there is a previous referral cookie in the same user’s browser the new cookies will overwrite it. SiteGround is not responsible for cookies intentionally deleted by users from their browser, or for modifications of your unique referral link, done by you or any other third party.

6. Relationship of the parties

Both SiteGround and you (together referred to as “they”) agree that they enter into these Terms as independent contractors, and nothing in these Terms will create any partnership, joint venture, agency franchise, sales representative, or employment relationship between them. 

7. Termination

7.1. We can terminate the Program, respectively - these Terms, at any time with no prior notice.

7.2. If any of the following occurs:

  • the Program is terminated; 

  • you are excluded from the Program; or 

  • your customer account is terminated;

we will no longer track the sales associated with the referral link, any pending award will not be attributed, and you will not qualify for any future awards. If any of those events occurs, you shall refrain from any actions which may directly or indirectly adversely affect the image and reputation of the SiteGround entities, as well the business relations with their current and potential customers. This provision shall service termination of these Terms.

8. LIMITATION OF LIABILITY

YOU AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU WILL NOT UNDER ANY CIRCUMSTANCES INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, HOLD US, OUR EMPLOYEES, OFFICERS AND/OR THIRD PARTY VENDORS LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES WHATSOEVER INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOST PROFITS, REVENUE, BUSINESS, DATA, LOST SAVINGS, OR ANY OTHER PECUNIARY LOSS BY YOU OR ANY OTHER THIRD PARTY. YOU AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU WILL NOT HOLD US LIABLE FOR UNAVAILABILITY OR INOPERABILITY OF THE REFERRAL LINK(S), THE SITEGROUND WEBSITE, OR FOR ANY TECHNICAL MALFUNCTION, COMPUTER ERROR, CORRUPTION OR LOSS OF INFORMATION. YOU AGREE THAT THE FOREGOING LIMITATIONS APPLY WHETHER IN AN ACTION IN CONTRACT OR TORT OR ANY OTHER LEGAL THEORY AND APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL WE BE LIABLE TO YOU IN THE AGGREGATE WITH RESPECT TO ANY AND ALL BREACHES, DEFAULTS, OR CLAIMS OF LIABILITY UNDER THESE TERMS OR UNDER ANY OTHER DOCUMENT FOR AN AMOUNT GREATER THAN EUR 100. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. YOU AGREE THAT IN THOSE JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE EXTENT PERMITTED BY LAW.

THIS PROVISION SHALL SURVIVE TERMINATION OF THESE TERMS.

9. Governing law. Jurisdiction

Any disputes related to these Terms will be governed by the governing law and dispute resolution provisions described in the SiteGround Terms of Service. 

10. Changes to the Referral Program Terms

We may alter these Terms at any time without prior notice. The amendments and/or supplements of these Terms shall be effective immediately upon posting on the website of SiteGround. If you do not agree to any amendments, you shall cease the use and share of the referral link.
