SiteGround Еcommerce Service - Specific Terms for Third-Party Services

This document outlines the legal notices and sets out the specific terms, conditions, and supplemental provisions (collectively “Specific Terms”) applicable to the access and use of Third-Party Services made available to you through the SiteGround Еcommerce Service interface. By accessing and/or using any Third-Party Service, you acknowledge and agree that you have read, understood, and will comply with the applicable Specific Terms, set out below, as well as with any other Specific Terms that may apply to the access and use of Third-Party Services.

The capitalized terms used in this document have the meanings given to them in the SiteGround Terms of Service, SiteGround Ecommerce Service Terms and/or the Privacy Policy.
The Specific Terms set out below (including any documents incorporated by reference) may be updated from time to time. You are solely responsible for reviewing and complying with any such updates.

  1. Payment processing services

    1. Stripe Connect Services (or as otherwise referred to by Stripe)

    By using the Stripe Connect Services in connection with the Ecommerce Service, you acknowledge and agree:

    1. to comply with Stripe Services Agreement (https://stripe.com/legal/ssa) and Stripe Connected Account Agreement (https://stripe.com/legal/connect-account);
    2. that you will not, directly or indirectly, conduct any business or transaction that constitutes a Prohibited Business or Restricted Business as defined in Stripe’s list available at https://stripe.com/en-bg/legal/restricted-businesses. You further represent and warrant that you will not use the Stripe Connect Services to process payments for, or on behalf of, any entity or individual engaged in a Prohibited or Restricted Business, and that you will comply at all times with Stripe’s applicable policies, terms and requirements; and
    3. that in addition to the processing of personal data described in our Privacy Policy, both SiteGround and Stripe may access and process information (incl. personal data) contained in your Connected Account(s) via the Stripe Connect Services. This may include, but is not limited to, transaction data, incl. personal data of your End Customers, and other related information necessary for the provision, management, and support of the Ecommerce Service and the Stripe Connect Services. Stripe Privacy Policy (https://stripe.com/privacy) applies to the processing of personal data by Stripe. The purposes for which SiteGround processes such information include but are not limited to (i) facilitating the technical and operational integration of the Stripe Connect Services into your Store; (ii) fulfilling our contractual obligations towards Stripe in connection with the integration and use of the Stripe Connect Services on your Store; (iii) providing support and resolving issues directly related to the Stripe Connect Services integration on your Store; (iv) Application Fee payouts, if any; (v) compliance purposes.
    1. PayPal payment services (or as otherwise referred to by PayPal)

    By using PayPal payment services in connection with the Ecommerce Service, you acknowledge and agree:

    1. to comply with the PayPal User Agreement (https://www.paypal.com/legalhub/paypal/useragreement-full);
    2. that you will not, directly or indirectly, conduct any business or transaction that violates PayPal’s Acceptable Use Policy (https://www.paypal.com/legalhub/paypal/acceptableuse-full). You further represent and warrant that you will not use the PayPal services to process payments for, or on behalf of, any entity or individual engaged in activities prohibited under PayPal’s Acceptable Use Policy, and that you will comply at all times with PayPal’s applicable policies, terms and requirements; and
    3. that in addition to the processing of personal data described in our Privacy Policy, both SiteGround and PayPal may access and process information (incl. personal data) related to your use of PayPal payment services. This may include, but is not limited to, transaction data, incl. personal data of your End Customers, and other related information necessary for the provision, management, and support of the Ecommerce Service and the PayPal payment services. PayPal Privacy Statement (https://www.paypal.com/privacy) applies to the processing of personal data by PayPal. The purposes for which SiteGround processes such information include but are not limited to (i) facilitating the technical and operational integration of the PayPal payment services into your Store; (ii) fulfilling our contractual obligations towards PayPal in connection with the integration and use of the PayPal payment services on your Store; (iii) providing support and resolving issues directly related to the PayPal payment services integration on your Store; (iv) Application Fee payouts, if any; (v) compliance purposes.
  2. Tax calculation services

    1. Stripe Tax Services 

    By using Stripe Tax Services (as defined in the applicable Stripe Services Agreement and Stripe Tax Services Terms) in connection with the Ecommerce Service, you acknowledge and agree to comply with the Stripe Tax Services Terms (https://stripe.com/legal/tax).

  3. Other Third-Party Services

    1. Let’s Encrypt SSL certificates

    By using Let’s Encrypt SSL certificates for your Store, you acknowledge and agree to comply with the Combined Certificate Policy and Certification Practice Statement (https://letsencrypt.org/documents/isrg-cp-cps-v5.1/).

    1. Google Maps

    The Ecommerce Service includes Google Maps features and content and their use is subject to the then-current versions of the: (1) Google Maps/Google Earth Additional Terms of Service (https://maps.google.com/help/terms_maps/); and (2) Google Privacy Policy  (https://policies.google.com/privacy). If you integrate Google Maps into your Store, you shall include a notice in your Store’s terms of service stating that your Store contains Google Maps features and content and their use is subject to the then-current versions of the: (1) Google Maps/Google Earth Additional Terms of Service (https://maps.google.com/help/terms_maps/); and (2) Google Privacy Policy (https://policies.google.com/privacy). Your and/or your Store visitors’ failure to comply with the applicable terms of the Google Maps/Google Earth Additional Terms of Service may result in suspending your access to the Store and/or the Ecommerce Service and/or terminating your Customer Account and the Agreement.
